These Terms of Service ("Terms") govern your use of the YardSaleHQ platform ("Service") operated by YardSaleHQ ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

The Service

YardSaleHQ is a platform that allows individuals to post and discover local garage sales, yard sales, estate sales, and moving sales. We provide the tools and infrastructure — we are not a party to any transaction between buyers and sellers, and we do not organize, host, or verify the sales listed on this platform.

Eligibility

You must be at least 13 years old to use YardSaleHQ. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@yardsalehq.com if you suspect unauthorized use of your account.

Posting a Sale

When you post a sale listing, you agree that:

• The information you provide — address, dates, hours, and description — is accurate to the best of your knowledge.
• You have the right to hold the sale at the address you list (it is your property or you have permission).
• You will not post misleading, fraudulent, or illegal listings.
• You will not use the platform for commercial retail, multi-level marketing, or any purpose other than personal property sales.
• You will not include contact information, phone numbers, or links in your listing description.
• You are solely responsible for ensuring your sale complies with all applicable local, city, county, and HOA regulations, including any permit requirements or limits on the number of sales allowed per year in your area. Rules vary significantly by location — check your local ordinances before posting.

Sale listings are public and visible to all visitors. You are solely responsible for the accuracy of your listings and for any interactions that result from them.

Platform — Not a Participant

YardSaleHQ is an interactive computer service as defined under 47 U.S.C. § 230 (the Communications Decency Act). We are not the publisher or speaker of third-party content posted by users. We are not responsible for the accuracy, safety, legality, or quality of any sale listing or any in-person transaction that results from using this platform. You attend sales and conduct transactions entirely at your own risk.

Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent sale listings.
• Harass, threaten, or harm other users.
• Attempt to access other users' accounts or data.
• Use automated tools to scrape, crawl, or mass-download content from the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Use the Service for any unlawful purpose.

Content Removal

We reserve the right to remove any listing or suspend any account that violates these Terms, at our sole discretion and without prior notice. We are not obligated to review listings before they are published, but we will act on reports of violations.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT VERIFY THE ACCURACY OF ANY USER-POSTED LISTING.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YARDSALEHQ AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE OR ANY SALE LISTING, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify and hold harmless YardSaleHQ and its owners, operators, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your listings, or your violation of these Terms.

Changes to These Terms

We may update these Terms at any time. We will post the revised Terms on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
